Fair Debt Collection Practices Act/California Rosenthal Act

Our team has extensive experience defending creditors, debt buyers and debt servicers against claims brought under the Fair Debt Collection Practices Act (FDCPA) and the California Rosenthal Act. Introduced by the Federal Trade Commission in 1978, the FDCPA governs debt collectors seeking to collect consumer debt. The Rosenthal Act, enacted the same timeframe as its federal counterpart, the FDCPA, contains many of the same collection agency obligations as the FDCPA and also extends to original creditors. Our experience helps clients navigate the complex nature of these lawsuits to achieve favorable results.
